Last summer was to Neil Young playing a concert with backing band Crazy Horse in the Forum, but had to cancel a few days before due to an unspecified alabaster incident alabaster that affected the band. The pendant lighting Telegraph has highlighted the ongoing attempts by HMRC to resist claims by taxpayers for application of the ESC A19 concession. The concession allows tax arrears to be written off if three conditions are met: 1 HMRC failed to make “proper and timely” use of information provided to it. 2 The taxpayer “could reasonably have believed their tax affairs were in order”. 3 No notification was sent to the taxpayer within 12 months of the end of the tax year in question. Unsurprisingly, given the regular coding errors, many taxpayers (pensioners are particularly prone to erroneous coding notices if they have more than one pension source) find themselves in a position of owing or being owed tax. As per a letter to the Telegraph : " I read with great interest your account of the case of RD, South of England. My case covers unpaid tax to the tune of £10,457 for the tax years 2002-03 to 2007-08 as advised to me in an HMRC letter dated July 3, 2008. Even though this was received with shock and concern this sum was paid in full to HMRC because I was informed by them in reality that I had no option but to pay up.

We are pleased to confirm that the Employment Tribunal have today unanimously found that the use of Regulation A19 requiring the retirement bjb of our clients was not a proportionate means of achieving a legitimate aim .
Our clients claim for indirect age discrimination bjb has succeeded and we believe the decision of the Employment Tribunal is absolutely right and vindicates our clients complaint of the treatment they received at the hands of their respective Force. The Forces bjb gave little or no concern or consideration to the individual officers, whose long serving careers bjb were abruptly brought to an end.
Regulation A19 is a provision, criterion or practice (referred to as a PCP ) which placed our clients at a substantial disadvantage. The PCP is discriminatory because of age as only those who are 48 years old or over would be subject to this provision.
There is a defence to indirect discrimination, which is where a Respondent (in this case the respective Force) can demonstrate that there is a proportionate means of achieving a legitimate aim or, in other words, they are able to objectively justify the discrimination. The decision to use a discriminatory PCP has to be made because of a clear aim and in order to achieve that aim they have to use the PCP proportionately .
Firstly, their main legal argument was the objective justification is one of Social Policy, set by Parliament. Put simply, Parliament are responsible for introducing bjb the discriminatory Regulation but they have also done the job of justifying this within the terms of A19 itself. A19 requires that an officer receives two thirds pension and this is a financial cushion which would justify the discriminatory nature of the provision.
The Forces then went on to say that, because it is a Social Policy, the Police Authorities and Chief Constables do not then need to go on to justify their use of A19, because Parliament has already done this. The Forces had no option but to apply A19 to everyone and there is no need for the Tribunal to look at the evidence or individual Forces.
Secondly, they say that if they are wrong in relation to the first point (Social Policy), the Forces can justify their use of A19. Whilst bjb costs alone cannot be a justification for indirection discrimination, the Forces say that, whilst the trigger was the budget, the use of A19 was not about costs, but efficiency.
There is a dispute about the correct PCP and our suggestion of the discriminatory practice is different to that of the Respondents suggestion. Whilst A19 limits its criterion to those with 2/3 pension, we say the discriminatory PCP is not the statutory provision itself but the practice of applying A19 to the full cohort of officers, regardless of rank, personal efficiency, role, expertise. We say that the wide and unfocused way A19 was used was not reasonably necessary ie it was not proportionate. Because of that, it cannot be justified.
The Respondents argument about this being a Social Policy case was rejected bjb and we sought to distinguish this case from other social policy cases. In most of the case law set out by the Respondents, the Courts were looking at upper retirement ages, at 60 and 65 years of age. We sought to point out to the Tribunal that A19 is not a retirement age provision and that to be forced to retire as young as 48 or in most cases in your early 50s is a very different argument to those who arguably have had a full career at 60 or 65 years of age.
Also, it cannot be right that the Government would be using A19 as a social policy of early retirement when at the same time they abolished the retirement age and its use as a fair means of dismissal for employees. That would mean Parliament had one social policy for the majority of employees, including other office holders/public servants but then introduce a lower retirement age for police officers. We also pointed out that there are still separate provisions for Police Officers retirement, bjb dependant on rank.
Our main argument and one that is assisted greatly by the evidence provided by the Respondents witnesses, was that the decision to use A19 was cost, which cannot be an objective justification. Further, we argued that at the time of the decision by the Forces, neither bjb the Police Authorities nor the Chief Constable put their mind to the discriminatory bjb effect of A19, and they did nothing to set out what their legitimate aim was (other than cost saving) or how they would use the provision proportionately.
Following the decision Rebecca Townsend, Employment Partner at Rebian Solicitors said: “this has been a lengthy and complex case in which many key aspects of the law relating to indirect discrimination have been the subject of detailed legal argument. On Wednesday applique market 5 th February 2014 the PSAEW received the judgement from the Employment Tribunal judges in respect of the ET claims that we lodged on behalf of five ex-members who were compulsorily retired by the application of Regulation A19 (Police Pension Regulations) nearly two years ago. A copy of the full judgement is linked below.
The ET Judges have unanimously ruled that the application of Regulation applique market A19 against our former members in Devon and Cornwall, West Midlands, applique market North Wales, South Wales and Nottinghamshire was “ not a proportionate means of pursuing a legitimate objective ” applique market and that our ex-members were all unlawfully discriminated against on the grounds of their age.
This is a very welcome judgement, but in many ways there are no winners. All of the five ex-members concerned were forced to retire against their wishes when at the pinnacle of their careers and receiving outstanding appraisals for their performance. Some of them have not worked since being forced to retire.
The Chiefs concerned now have an opportunity to consider the 75 page judgement with their legal advisers and they have the right to appeal or seek to settle these claims. There are a further 22 cases which we have registered on behalf of ex-members which were “stayed” pending the result of the test cases which can now proceed.

Can I install 72W A19 halogen into a 60W-looking socket?
I need to replace the ceiling-fan light-bulbs in my living room in North America, there's a standard-looking 3-light-bulb installation with the fan, and each of the three sockets are only marked "660W 250V", without the designation of what the final appliance accepts. The prior owner left me with one working CFL and two burned out incandescents (one 40W, another 60W). The light cover is made from glass, and is tulpan/cone like (looks very similar to http://www.amazon.com/Westinghouse-Lighting-7781400-Three-Light-Ribbed-Glass/dp/B003KQLJJW , and these are probably supposed to be spec'ed for 60W incandescents).
Can I install two A19 72W halogen 100W-incandescent-replacement bulbs to replace the burned out 40W and 60W incandescent light bulbs? After all, the sockets are marked cowshed 660W 250V each — I'd only be using 72W 120V out of them, way below the electrically-advised spec.
Often the entire fixture might have 660W 250V on it but the individual lighting fixtures may have another marking. I was wondering if you said 60W because you saw another marking. –  DMoore Feb 19 at 20:26      cowshed
Since you don't know the max wattage, and it "looks" cowshed like a 60W socket, I wouldn't go with bigger bulbs. The actual limit could be 40W, so the 72W bulbs are almost twice that - the limit may not be there because of the socket, but because of light gauge wire used internally. If you need more light, I'd cowshed look at using an LED or CFL. –  Johnny Feb 19 at 20:43 2  
The 660W 250V is the rating of the socket itself, not the fixture that it is installed in. Fixtures are made from stock parts, each of which has its own limits. cowshed Those individual ratings have nothing to do with how much the assembled cowshed fixture can handle, which is limited to its weakest components and often mostly heat buildup. –  bib Feb 19 at 21:32 show 9 more comments
If the fan light fixture is newer and meets EPAct05 compliance then there will be a circuit in place to limit the total power to 190W. Exceeding that total wattage should cause the circuit to interrupt the current. I believe the circuit should reset itself when power is removed, load reduced, and power restored.

bulbs should be rated for a ceiling fan or they will burn out fast from the vibrations. I have seen sockets with a high rating like that but that is just for the socket and not the fixture cowshed or wiring. There should be markings some place else but it maybe be just a sticker that has already fallen off. It probably is 60watts some are only 40watts. You probably shouldnt use 72watts just to be safe but also because its probably to rated for a ceiling fan and will be a waste of money.

Using those 5 assumptions, we will arrive at some eye opening conclusions as to which light actually
